This Terms of Service ("Agreement") is a legally binding contract between you ("User" or "you") and
Hong Kong Chaorong Technology Co., Limited ("we", "us", or "our") governing your download, installation,
and use of the mobile application "Live Jigsaw: Halloween Puzzle" ("the App"). By accessing or using the App
in any manner (including but not limited to downloading, installing, or interacting with its features), you
acknowledge that you have read, understood, and unconditionally agree to be bound by all terms and conditions
of this Agreement. If you do not agree to these terms, you must immediately cease using the App and uninstall
it from your device.
1. Service Description
The App provides the following core functions and services to Users, subject to updates or modifications as set
forth in Section 8:
- Halloween-themed jigsaw puzzle content with adjustable difficulty levels
(e.g., 20-piece, 100-piece, 500-piece options) to accommodate different User preferences.
- Local progress saving (no account registration required), allowing Users to
pause and resume puzzles at any time without losing in-progress work.
- In-app purchase options for premium features, including but not limited to ad
removal, unlimited puzzle hints, and exclusive Halloween puzzle packs.
- Optional social sharing functionality, enabling Users to share completed
puzzle screenshots or progress to third-party social media platforms (e.g., Facebook, Instagram) (subject to
the third party’s terms of service).
- Free access to basic features supported by non-intrusive third-party
advertisements (Users may opt out of ads via in-app purchase).
2. Eligibility
To use the App, you must meet the following eligibility requirements:
- You are at least 13 years of age, or you have attained the age of majority (or equivalent legal capacity)
under the laws of your jurisdiction (e.g., 18 years old in most regions).
- If you are a minor (under the age of 13 or under the age of majority in your jurisdiction), you may only use
the App under the direct supervision of a parent or legal guardian. The
parent/guardian assumes full legal liability for your use of the App, including any purchases or violations
of this Agreement.
- We reserve the right to verify your eligibility and restrict or terminate access if we reasonably believe
you do not meet these requirements.
3. Accounts and Data
The App is designed to minimize data collection and account requirements, with the following provisions for User
data:
- No mandatory account: You may use all basic App features without creating an
account. Progress and preferences are saved locally on your device (not on our servers).
- Cloud save (if applicable): If we introduce cloud-based progress saving in
future App updates, this feature will only be activated with your explicit, prior
consent. You may opt out of cloud saves at any time (subject to feature limitations).
- Progress loss risk: Changing devices, resetting your device, or uninstalling
the App may result in the loss of locally saved progress. We strongly recommend that you regularly back up
your progress (e.g., via device backup tools) to avoid data loss. We shall not be liable for any progress
loss caused by device changes or user error.
4. User Conduct
You agree to use the App in compliance with this Agreement, applicable laws, and ethical standards. You shall not engage in any of the following activities:
- Reverse-engineer, decompile, disassemble, modify, or tamper with the App’s source code, algorithms, or
proprietary components (including but not limited to artwork, music, and game logic).
- Use cheats, bots, automation tools, hacks, or other unauthorized software to manipulate the App’s operation
(e.g., to unlock premium features without payment or skip puzzle difficulty).
- Block, bypass, or interfere with in-app advertisements (such actions may disrupt the App’s stability, impair
free access to basic features, and violate our advertising partners’ terms).
- Upload, share, or transmit through the App any illegal, harmful, offensive, or infringing content (e.g.,
malware, hate speech, copyrighted material without permission, or content promoting violence).
- Use the App for commercial purposes (e.g., reselling access to premium features, monetizing App content on
third-party platforms, or using the App to promote products/services without our written consent).
Violation Consequences: If we determine (in our sole discretion) that you have
violated this Section, we may take immediate action, including but not limited to terminating your access to the
App, disabling local progress, or restricting future use. We may also pursue legal remedies if your actions
cause us or third parties to suffer damages.
5. Intellectual Property
All intellectual property rights in and to the App and its content are exclusively owned by Hong Kong Chaorong
Technology Co., Limited or our licensors (e.g., music composers, artwork designers). This includes but is not
limited to:
- Copyrights in the App’s source code, user interface, artwork, music, sound effects, and puzzle content.
- Trademarks, service marks, and logos associated with the App (e.g., "Live Jigsaw: Halloween Puzzle" and our
company name).
- Patents (if applicable) covering the App’s unique features or functionality.
We grant you a limited, non-exclusive, non-transferable, revocable license to use
the App solely for your personal, non-commercial purposes in accordance with this Agreement. This license does
not grant you any ownership rights in the App or its content. You may not:
- Copy, reproduce, distribute, or publicly display any part of the App (e.g., sharing App files with others or
uploading puzzle content to a website).
- Resell, lease, license, or otherwise commercially exploit the App or its features (e.g., charging others to
access premium features you purchased).
- Alter or remove any copyright, trademark, or proprietary notices displayed in the App.
6. Free Access & In-App Purchases
6.1 Free Access
The App is available for free download from authorized app stores (e.g., Apple App Store, Google Play Store).
Free access includes basic puzzle features and is supported by non-intrusive third-party ads (we reserve the
right to adjust ad frequency or format, provided ads remain non-disruptive).
6.2 In-App Purchases
Premium features (e.g., ad-free mode, unlimited hints, exclusive puzzle packs) require payment via in-app
purchases. All transactions are processed exclusively through the Apple App Store or
Google Play Store (as applicable to your device). We do not process payment data (e.g., credit card
information) directly; such data is handled by the respective app store, subject to its privacy policy and terms
of service.
6.3 Refunds
We do not issue refunds for in-app purchases directly. For refund requests, you must contact the customer support
of the app store through which you made the purchase (e.g., Apple Refunds for iOS devices, Google Play Support
for Android devices) and follow their refund policies. Refund eligibility (e.g., time limits, reason for
request) is determined solely by the app store, not by us.
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO
THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability: The App is not guaranteed to be
suitable for your specific needs, error-free, or compatible with all devices.
- Implied warranties of fitness for a particular purpose: We do not warrant that
the App will meet your expectations (e.g., uninterrupted use, bug-free performance).
- Warranties of non-infringement: We do not warrant that the App will not
infringe on the intellectual property rights of third parties (though we take reasonable steps to ensure
compliance).
We shall not be liable for:
- Network or device compatibility issues (e.g., the App not working on an outdated operating system).
- Data loss (e.g., progress loss due to device failure, as noted in Section 3).
- Indirect, incidental, consequential, special, or punitive damages (even if we have been advised of the
possibility of such damages), including but not limited to lost enjoyment, lost time, or third-party claims.
- Content or actions of third parties (e.g., in-app advertisers, social media platforms linked via sharing
features). Third-party ads reflect the views of the advertiser, not ours, and we do not endorse or guarantee
the accuracy of ad content.
8. Service Modifications
We reserve the right, in our sole discretion, to modify, update, or discontinue the App or its features at any
time, with or without prior notice. This includes but is not limited to:
- Adding, removing, or altering puzzle content, features, or in-app purchase options.
- Suspending or discontinuing the App temporarily (e.g., for maintenance) or permanently (e.g., due to low
usage or legal requirements).
- Updating the App to comply with new laws, app store policies, or security standards (you may be required to
install updates to continue using the App).
We shall not be liable to you or any third party for any loss or damage resulting from modifications to the App
or its services, except as required by applicable law.
9. Governing Law & Dispute Resolution
9.1 Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the People’s Republic of China,
excluding its conflict-of-law principles (which would otherwise apply the laws of another jurisdiction).
9.2 Dispute Resolution
- First Step: Good-Faith Negotiation: Any dispute, claim, or controversy arising
out of or relating to this Agreement or your use of the App (collectively, "Disputes") shall first be
resolved through good-faith negotiation between you and us. You must contact us via the email provided in
Section 11 to initiate negotiation, and we will respond within 15 business days of receiving your inquiry.
- Second Step: Litigation: If the Dispute cannot be resolved through negotiation
within 30 days of your initial contact, either party may submit the Dispute to the people’s court having jurisdiction over the place where Hong Kong Chaorong Technology
Co., Limited is located for resolution.
- EU User Exception: If you are a resident of the European Union (EU), you may
also use the EU Online Dispute Resolution (ODR) Platform (available at https://ec.europa.eu/odr) to submit and resolve Disputes
related to this Agreement. The ODR Platform is a free, independent service managed by the European
Commission to facilitate cross-border dispute resolution.
10. General Terms
- Entire Agreement: This Agreement constitutes the complete and exclusive
understanding between you and us regarding your use of the App, superseding all prior or contemporaneous
communications, agreements, or understandings (whether oral or written).
- Severability: If any provision of this Agreement is deemed invalid, illegal,
or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force
and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the
original intent of this Agreement.
- Interpretation: Hong Kong Chaorong Technology Co., Limited retains the sole
discretion to interpret the terms of this Agreement. Our interpretation shall be reasonable and binding on
you, unless a court of competent jurisdiction determines otherwise.
- Assignment: You may not assign or transfer this Agreement or your
rights/obligations under it to any third party without our prior written consent. We may assign this
Agreement to a third party (e.g., in the event of a merger, acquisition, or sale of assets) without your
consent, provided the assignee agrees to be bound by these terms.
